Covenant Enforcement Policy
This policy establishes the standard procedures used by the Association to ensure consistent, fair, and uniform enforcement of the Association’s Covenants, Conditions & Restrictions (CC&Rs), Bylaws, and adopted rules.
Authority
The Board of Directors is responsible for enforcement of the governing documents and may act through its managing agent.
Violation Identification
Violations may be identified through routine inspections, homeowner reports, or management observations. All violations are documented and tracked by type.
Violation Types
Violations are categorized by type (e.g., yard maintenance, trash containers, parking, architectural). Only violations of the same type are counted together for enforcement and fine purposes.
Notice Process
The Association typically follows a structured process:
- Courtesy notice
- Follow-up notice(s), if needed
- Opportunity to correct, submit a plan, or request a hearing
Compliance Period
Homeowners are generally given 10 days to correct a violation unless otherwise specified.
Fine Policy
A fine may be assessed when three (3) or more violations of the same type occur within a twelve (12) month period.
The twelve (12) month period is applied on a rolling basis, meaning the most recent violations within the prior twelve (12) months are used to determine whether a fine applies.
Beginning with the third violation, a $100 fine may be assessed for each recurring violation.
If earlier violations fall outside the 12-month period, they are no longer counted toward the fine threshold.
Hearings and Appeals
Homeowners may request a hearing, submit evidence, or provide a plan for compliance. The Board will review and make a determination in good faith.
Collection of Fines
Unpaid fines may result in additional fees, liens against the property, and collection actions as permitted by law.
Board Discretion
The Board will make reasonable efforts to enforce rules consistently but retains discretion to address unique circumstances, safety concerns, or hardship situations.
This policy is intended to supplement the Association’s governing documents. In the event of a conflict, the governing documents control.
